PANGALAWANG KASAL

Q. Dear attorney, magandang araw po. May problema po ako sana matulungan po ninyo ako kung ano ang dapat kung gawin.
Nagpakasal po ako noong 1997 sa isang guy pero hindi po kami nagsama ng matagal kasi pabalikbalik po ako sa Hongkong at that time hanggang sa nawala na lang ang communication namin.

Hanggang sa nakahanap po ako ng isang guy at nagpakasal po ako sa kanya ngayon. Noong nagsubmit po ako ng papers ko sa Hongkong papunta dito sa Canada yung pangalawang asawa ko po ang nadeclare ko na asawa ko. Considering na matagal ng panahon na wala aking contact sa una kong asawa , okay lang po ba ito ? At makukuha ko po ba siya dito sa Canada bilang asawa ko ? Sana po matugunan ninyo ang sulat kong ito. More power! Dina

Ans: Assuming na valid and una among kasal, it follows na ang pangalawa mong pag-pakasal ay walang bisa o “null and void”, due to an existing and subsisting marriage.

Kung gusto mo talagang maayos ang “marital status” mo ng sang-ayon sa batas, ang dapat mong gawin ay mag-file ka ng petition for the “annulment of your first marriage” sa Pilipinas at kaakibat dito at mag-file ka rin ng petition for “declaration of nullity of your second marriage.”

Pag-ito ay natapos na at binigyan ng basbas ng korte, maari ka ng mag-pakasal muli sa sino mang ibigin mo o sa kasalukuyang partner ( nabanggit na pangalawang asawa mo ) mo ngayon na itinuturing mong asawa .

Kung hindi mo maisayos ang mga napaka masilang bagay na ito tungkol sa iyong pag-katao o marital/civil status, maaring mag-kaka problema ka sa pag-sponsor ng iyong nasabing asawa, dahil hindi siya maaring ituring na part of your family bilang isang legal na asawa.
