PAGLIPAT NG TITULO SA MINANANG LUPA

Q. I have a question regarding sa land title po namin, my father and my mother passed away sometime in 1975 and 2007 respectively .

Yung naka indicate po sa land title is pangalan ng mother ko married to my father, since tatlo na lng po kaming natirang magkapatid, gusto po namin na matransfer yung land title para sa aming tatlo, ano po ang mga procedure na dapat naming gawin para ma transfer na sa pangalan namin ung land title.

Ans: Ang una ninyong gawin ay makipag ugnayan sa abogado upang mag pabalangkas ng dokomento. Ang tawag nito ay “EXTRAJUDICIAL SETTLEMENT OF ESTATE “ ng inyong mga namayapang magulang.

Ang Extrajudicial Settlement ay inyong lalagdaang mag kakapatid sa harap ng notaryo publiko. Sa pamamagitan nito ay inyong pag papartihin ang lahat ng mga ari-arian ng inyong yumaong magulang. Ang partihan ay pareho-pareho kayong magkakapatid ng sharing or mana.

Maari ninyong pag tatlohin ang nabanggit na lupa at magkakaroon ang bawat isa sa inyong magkakapatid ng titulo ayon sa kanyang parte. Kung ito ay gagawin ninyo kailangan ay ipa-subdivide ung lupa at kailangan ang serbisyo ng geodetic engineer or surveyor at ipapaaproved ito sa Land Registration Authority(LRA).

Kung ayaw naman ninyong pag papartihin ang lupa, at maging buo pa rin ito, ang titulo nito ay papalitang pangalan ninyong tatlong magkakapatid bilang co-owners. Hindi na kailangan ang serbisyo ng geodetic engineer or surveyor kung wala kayong balak na pag tatlohin ang lupa.

Pag natapos na ang extrajudicial settlement, mag kakaroon pa ng legal notice na ipapapublish sa newaspaper of general circulation for three(3) weeks at pagkatapos bibigyan kayo ng kopya ng nasabing publication at affidavit of publication ng dyaryo.

At from there, makipag-ugnayan na kayo sa BIR para mag bayad Estate Tax , penalty at interest charges dahil sa hindi kaagad ninyo naasikaso at nabayaran ang kaukulang taxes. At pagkatapos nito bibigyan kayo ng BIR ng CAR, or certificate authorizing registration ng inyong Extrajudicial Settlement para sa Register of Deeds upang sa ganoon ma cancel ung lumang titulo ng lupa at bibigyan kayo ng panibagong titulo ayon sa mga pinagkasunduan ninyo sa Extrajudicial Settlement.
