Q. Good day po Atty. Isa po akong single at nagkaanak po ako sa isang lalaki na may asawa wala po sila anak ng legal wife nya. May isang anak po kami na minor age pa po na pirmado ang ama nya sa kanyang birth certificate.
Namatay po father ng anak ko last year at may naiwan po sya ari arian like bukirin, sasakyan, kalabaw at benefits sa goverment, may sakahan na ipinamana ang father nya sa father ng anak ko ngunit ang mga ito ay hindi naisalin sa pangalan ng tatay ng anak ko at ang sasakyan naman po niya ay nakapangalan din sa legal wife dahil yung wife po nya ang may kakayanan at may document para sa paglabas ng sasakyan. Ano po ba hakbang ang mga dapat kong gawin may karapatan po ba humabol ang anak ko sa mga ari arian naiwan ng father nya sa kanyang legal wife. Ano ano po ba ang mga dapat kong habulin para sa anak namin? Respectfully Michel.
ANS: Base sa kwento mo at kung wala ng mga magulang ang ama ng anak mo, ang maituturing na mga compulsory heirs ng namatay ay ung surviving spouse at ang anak na namatay na ama ng inyong anak ay maituturing na mga compulsory heirs although ung anak ninyo at maituturing na isang illegitimate child . At bilang mga compulsory heirs ay entitled silang humalili sa mga naiwang ari-arian ng namatay tulad mga nabanggit mo kasama na ung mga government benefits ng namatay na ama ng inyong illegitimate child.
Ang sabi ng batas ang legitime ng surviving spouse ay kapareho ng legitime or mana ng legitimate child. Ung legitme naman or mana ng illegitimate child ay katumbas lamang ng ½ ng mana ng legitimate child or surviving spouse. For Example pag ang legitime ng surviving spouse/legitimate child is P1M, ung legitime or mana ng illegitimate child is only the equivalent of ½ or P500K lang.

Kung ipagkakait sa inyong ana kung kanyang mana, ay maari mag file ng Petition ang inyong anak sa korte for Judicial Settlement and Partition of the Estate upang sa ganoon ay ung nararapat na mana or legitime ng inyong anak ay maipag ka loob sa kanya ng sang ayon sa batas.
