CONJUGAL BA ANG LUPA NA NABILI NOONG DALAGA PA ANG ASAWA?

Q. Ang asawa ko ay mayroong lupa na naka pangalan sa kanya ung titulo na kanyang nabili  noong dalaga pa siya. Ang nasabing property ay nabenta ng asawa ko without my consent.   Hindi rin ako binigyan ng share ng sales proceed dahil sa kanya lang daw ung lupa dahil nabili  niya ito noong sya a dalaga pa noon. Ang tanong ko po, di ba entitled ako sa share ng property  at ang pinagbilhan nito dahil ito ay kasama sa aming conjugal property?  

ANS: Depende yan kung kailan kayo kinasal. Kung kayo ay kinasal at the time na HINDI PA  effective ang Family Code or before Aug 3, 1988, ang nasabing lupa sa ilalim ng Civil Code, ay  considered as paraphernal property ng inyong asawa at hindi maituturing na conjugal property,  kaya maari niya itong ibenta ng walang marital consent at magkaroon ka ng parte sa pinag  bentahan nito.  

However, kung kayo ay kinasal na effective ng ung Family Code, at WALA kayong pre-nuptial or  marriage settlement na pinirmahan bago kayo kinasal na hindi kasama sa inyong conjugal or  absolute community property ung inyong mga ari-arian na napundar bago kayo kinasal, ang  nasabing property sa ilalim ng Family Code, as amended, ay kasama or maging bahagi ng  inyong absolute community property, at kakailanganin ang marital consent sa pag benta nito ay  hati din kayo sa pinabilhan nito sang ayon sa Art. 91 ng Family Code, as amended, maliban na  lang na kung bago kayo kinasal ay mayroong siyang ng legitimate na anak during the first  marriage. Sa ganitong situation , ang nasabing property ay hindi maaring maisama sa inyong  community property, ayon sa Art.91(3) ng Family Code.
