CERTIFICATE OF LAND OWNERSHIP AWARD(CLOA) MAARING BANG BILHIN?

Q. Hello Atty. Wong, mayroon pong inaalok sa akin na agricultural land na 3  hectares. Ang hawak ng seller na papeles ay ung tinatawag na Certificate of  Land Ownership Award(CLOA). Maari ko bang bilhin ko ang lupa at hindi po ba  ako magka problema?  

ANS: Hello there, ang CLOA, or Certificate of Land Ownership ay isang  dokomento kung saan ang lupa na-iaward sa grantee ay beneficiary ng  Departmet of Agrarian Reform(DAR) ayon sa Comprehensive Agrarian Reform  Law(R.A. No.6657).  

 Ang CLOA ay pinagkakaloob ng Department of Agrarian Reform(DAR) sa  mga Land Reform beneficiaries. Mag-ingat sa pag bili ng lupa na covered ng  CLOA, dahil marami itong mga kaakibat na mga restrictions at conditions. Ayon  sa Section 27, ng CARL Law, ang lupa ma- acquired sa ilalim ng nasabing batas,  ay hindi maaring ibenta, ilipat, sangla or i-assign sa iba maliban na lang sa  pamamagitan sa pagmana ng mga heirs ng CLOA beneficiary na namatay or sa  LandBank or sa gobyerno, at sa ibang qualified na beneficiaries sa loob ng 10  years from the date of award. At magpaganoon pa man, ang mga anak at asawa  ng nag lipat nito ay mayroong karapatang bilhin uli ang lupa, mula sa gobyerno,  LandBank sa loob ng 2 taon mula nang nailipat ito sa qualified beneficiary. 

Kung hindi pa fully paid ang lupa on the part of beneficiary ang “rights” ng  lupa ay maaring ilipat or isalin sa sino mang tagapag mana ng land beneficiary at  sa ibang beneficiary sa kondisyon na ang hahalili ay personally mag cultivate ng  lupa. Pag hindi ito nasunod ang lupa ay ibabalik sa Landbank of the  

Philippines(LBP). Kung hindi ka naman maituturing na “Qualified Beneficiary” sa  ngayon, mahirap sumugal sa lupang ito. 

 Bago mo bilhin ang inaalok sa iyo, ay makipag ugnayan muna kayo sa  Department of Agrarian Reform(DAR) at alamin mo ano ang status ng nasabing  lupa, at kung sakali mang maari itong mailipat sa iba, at kung ikaw ay considered  as “Qualified Land Reform Beneficiary. Take note na ayon sa batas, ano mang  pag benta o pag lipat ng lupa na labag sa restriction na sinasaad ng CARL ay  considered as null and void so masasayang lang and perang ibabayad mo.
